Terms of Service

1. Who we are and acceptance of these Terms

heicjpg.online (the "Service", "we", "us") is operated by BDK Media Daniel Bihun, Poland. Contact: contact@heicjpg.online.

By accessing or using the Service you confirm that you have read, understood and agree to be bound by these Terms of Service (the "Terms") together with our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.

2. The Service

The Service converts HEIC, HEIF and HIF image files to JPG, free of charge and without registration. We may set and change technical limits at any time (for example the number of files per batch, maximum file size or daily conversion limits), and we may modify, suspend or discontinue the Service, in whole or in part, at any time and without prior notice.

The Service is a conversion tool, not a storage or backup service. Converted files are deleted automatically after 30 days at the latest, and we may delete them earlier for technical, legal or security reasons. Always keep your original files.

3. Who may use the Service

You must be at least 13 years old (or older where your local law requires a higher minimum age for digital services) to use the Service. If you use the Service on behalf of a company or other organization, you represent that you are authorized to bind that organization to these Terms.

4. Your files

• You retain all rights to the files you upload. We claim no ownership of your content.
• You grant us a limited, non-exclusive, worldwide, royalty-free technical licence to receive, store, convert, deliver and delete your files, solely to the extent necessary to operate the Service.
• You are solely responsible for the files you upload. You represent and warrant that you own them or hold all rights and permissions needed to upload and convert them, and that they do not violate any law or the rights of any third party.
• Download links use long random tokens. You are responsible for keeping your links confidential; anyone who has a link can download the file behind it.

5. Acceptable use

You agree that you will not:

• upload or convert content that is illegal under any applicable law, including in particular any material depicting the sexual abuse or exploitation of minors — such material will be reported to the competent authorities;
• upload content that infringes copyright, trademarks, privacy, personality rights or any other rights of third parties;
• upload files containing malware or any other harmful code;
• probe, scan, overload, disrupt or interfere with the Service or its infrastructure, or attempt to gain unauthorized access to it;
• bypass or attempt to bypass technical limits, or use bots, scripts or other automation to access the Service in bulk;
• resell, rent out or commercially redistribute the Service itself, or present the Service as your own product.

We may, at our sole discretion and without prior notice, remove files, throttle usage or block access to the Service (for example by IP address) where we reasonably believe that these Terms are being violated or the Service is being abused.

6. Disclaimer of warranties

The Service is provided free of charge, "as is" and "as available", without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy or error-free operation. We do not warrant that the Service will be uninterrupted, secure or defect-free, that conversion results will meet your expectations, or that any file will remain available for download for any period of time. Your sole remedy if you are dissatisfied with the Service is to stop using it.

7. Advertising and third-party services

The Service is financed by advertising. We display ads served by Google AdSense, and pages of the Service load advertising scripts from Google. Ads and links to third-party websites do not constitute our endorsement. We are not a party to, and accept no responsibility for, any dealings between you and any advertiser or third-party website, including their products, services, content and privacy practices. 8. Intellectual property

The Service itself — including its design, texts, graphics, logos and code — is owned by us or our licensors and is protected by copyright and other laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, modify, distribute or create derivative works of the Service, in whole or in part, without our prior written consent.

9. Limitation of liability

To the maximum extent permitted by applicable law:

• we shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of data, files, profits, revenue, business or goodwill, arising out of or in connection with the Service, even if we have been advised of the possibility of such damages;
• we shall not be liable for the deletion of, failure to store, corruption of or failure to convert any file, nor for access to files by third parties resulting from your sharing of a download link;
• our total aggregate liability for all claims relating to the Service shall not exceed EUR 50 (fifty euros).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for damage caused intentionally or by gross negligence, or your mandatory statutory rights as a consumer.

10. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold us harmless from and against any claims, damages, liabilities, costs and expenses (including reasonable legal fees) asserted by any third party and arising out of the files you upload, your use of the Service, or your breach of these Terms.

11. Reporting copyright infringement and abuse

If you believe that a file available through the Service infringes your rights or violates these Terms, email us at contact@heicjpg.online with the exact download link and a short description of the problem. We will review every report and, where justified, remove the file promptly.

12. Changes to these Terms

We may amend these Terms from time to time, for example when the Service or the law changes. The current version is always published on this page together with its "Last updated" date, and material changes will be announced on the homepage. Continued use of the Service after changes take effect constitutes acceptance of the amended Terms.

13. Governing law and disputes

These Terms are governed by the laws of Poland. If you are a consumer, you additionally retain the protection of any mandatory provisions of the law of your country of residence. We will always try to resolve any dispute amicably first — just write to us. Otherwise, disputes shall be resolved by the competent courts; for users who are not consumers, the courts having jurisdiction over our registered office in Poland shall have exclusive jurisdiction.

14. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any provision is not a waiver of it. These Terms and the documents referred to in them constitute the entire agreement between you and us regarding the Service. We may assign our rights and obligations under these Terms in connection with a transfer or sale of the Service. These Terms are provided in several language versions for convenience; in the event of any discrepancy, the English version prevails.
